JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-09-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Excise Case No. 58 of 2020 for the offences under Section 30(a) of the Bihar Prohibition and Excise Amendment Ac, 2018. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case total 3564 litres of foreign liquor was seized from the truck of which co-accused Satpal and the petitioner, who were driver and assistant driver, were arrested.

Considering the fact that huge quantity of foreign liquor was seized from the truck in which the petitioner was assistant driver, the Court is not inclined to grant bail to him for

Patna High Court CR. MISC. No.24763 of 2020(2) dt.23-09-2020 2/2 the present. The application is dismissed. He may renew his prayer for bail after 5th January, 2021.
