JUSTICE SATYAVRAT VERMA ORAL ORDER 13-12-2021 Heard learned counsel for the petitioner and Shri Arvind Kumar, learned Standing Counsel for the Vigilance. The petitioner seeks regular bail in connection with Special Case No. 09 of 2021 arising out of Vigilance (Patna) P.S. Case No. 12 of 2021 dated 08.03.2021 instituted for the offences under Section 7(a) of the Prevention of Corruption Act, 1988.

Learned counsel for the petitioner submits that the petitioner is in custody since 10.03.2021, is a person with clean antecedent and is a contractual employee of the State Government.

Learned counsel for the petitioner submits that allegation is of taking bribe of Rs. 3,300/- for doing the work which was assigned to him.

No.38271 of 2021(2) dt.13-12-2021 2/2 Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case by the informant as his wife is also working in the office of the C.D.P.O. as a Sevika and she never raised any imputation against this petitioner that he in any manner was involved in demanding bribe when it was the Sevika who used to supply all the documents to the petitioner based on which the concerned certificates, as alleged in the F.I.R., were to be issued. Learned standing counsel for the Vigilance vehemently opposes the prayer for regular bail of the petitioner. Considering the fact that the petitioner is in custody since 10.03.2021 and is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs.

10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance, Muzaffarpur in connection with Special Case No. 09 of 2021 arising out of Vigilance (Patna) P.S. Case No. 12 of 2021 subject to the condition as laid down under Section 437 (3) Cr.P.C.
