====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 24-08-2022 Heard Mr. Vikram Singh, learned counsel appearing on behalf of the petitioner and Mr. Yogendra Kumar, learned A.P.P. for the State.

Mr. Vikram Singh, learned counsel for the petitioner submits that earlier the prayer for bail was rejected vide order dated 14.12.2021 passed in Criminal Miscellaneous No. 27768 of 2021. Other co-accused persons namely Md. Nuzwa @ Nujwa has been granted bail by a co-ordinate Bench of this Court vide order dated 21.07.2022 passed in Criminal Miscellaneous No. 22988 of 2022, Md. Sabir @ Sabir has been granted bail by a co-ordinate Bench of this Court vide order dated 18.05.2022 passed in Criminal Miscellaneous No. 24414 of 2022 and Md. Nasir has been granted bail by this Court vide

Patna High Court CR. MISC. No.31553 of 2022(3) dt.24-08-2022 2/2 order dated 22.02.2022 passed in Criminal Miscellaneous No. 36686 of 2021. He further submits that in view of the fact that other co-accused persons against whom similar allegation has been made have already been granted bail, he seeks to withdraw the present bail application on behalf of the petitioner with a liberty to move before the appropriate forum. Learned A.P.P. submits that he has no objection if the petitioner approaches the appropriate forum.

The present bail application stands dismissed as withdrawn with a liberty to the petitioner to avail remedy in accordance with law before appropriate forum. It has been pointed out by the office that records of Criminal Miscellaneous No. 22988 of 2022 has not been made available till date. The office is directed to maintain the records in accordance with the rule prescribed so as the same be produced and made available forthwith. The concerned Section In-charge must be careful in the future.
