====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 27-06-2018 Heard Sri Devendra Kumar , learned counsel for the petitioner and Sri Jagdhar Prasad, learned Additional Public Prosecutor.

The sole petitioner, having clean antecedent, which fact has been stated in paragraph no. 3 of the petition, apprehending his arrest in connection with Complaint Case No. C2-46 of 2016 , Tr. No. 206 of 2017 , registered for the offence under Section 47(A) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.

It was submitted by learned counsel for the petitioner that petitioner is a worker in a petrol pump and from petitioner's petrol pump recovery of five bottles of Bear

Patna High Court Cr.Misc. No.33867 of 2018(2) dt.27-06-2018 2/2 containing 3.250 liters of Bear was shown and petitioner on the basis of disclosure made by some of the persons has been made accused.

Considering the nature of accusation and clean antecedent of the petitioner as well as the fact that nothing was recovered from possession of the petitioner , in the event of his arrest or surrender within a period of six weeks from today, let the petitioner Vinod Sah @ Vinod Kumar Sah be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge - cumSpecial Judge , Sheohar / concerned court in connection with Complaint Case No. C2-46 of 2016, Tr. No. 206 of 2017 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973.
