The petitioner apprehends his arrest in Chandi P.S. Case No.347 of 2018 registered under Section 30(a)(d), 37(b)(c) of Bihar Prohibition and Excise Act.

The police on information that one person creating nuisance after taking wine in Madhopur Bazar arrested him who disclosed his name as Krishna Murari Keshari. While the police was returning to police station, the police also got information that Siyaram Yadav was preparing liquor and when the police reached near the Sagwan trees of Maheshwar Yadav. Police saw two persons were preparing liquor. On chase, Siyaram Yadav was apprehended who disclosed that Bulkan Yadav was managed to flee away.

Patna High Court CR. MISC. No.30678 of 2019(2) dt.09-05-2019 2/2 The learned counsel for the petitioner submits that he has got personal enmity with Siyaram Yadav. Petitioner has got no criminal antecedent. Petitioner was never indulged in preparing the liquor.

Taking into consideration the fact that the name of the petitioner surfaced in the case on the basis of the disclosure made by Siyaram Yadav and nothing has been recovered from the possession of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Additional District & Sessions Judge-cum-Special Judge, Excise, Nalanda at Biharsharif in connection with Chandi P.S. Case No.347 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
