JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-01-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 394 of the Indian Penal Code.

As per the prosecution case, two unknown miscreants looted informant's motorcycle on the point of pistol. One of them shot fire causing injury on the thigh of the informant. On the disclosure of the petitioner, stolen motorcycle of the informant was recovered in front of the house of the petitioner. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Test Identification

Patna High Court CR. MISC. No.40799 of 2021(2) dt.04-01-2022 2/2 Parade has not been carried out till date. He is in custody since 9.12.2020. Charge sheet has already been submitted. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IX cum SJ IX, Patna in Gopalpur Police Station Case No. 291 of 2020.
