JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 21-12-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Jahanabad P.S.Case No.319 of 2013 registered under Section 420 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the petitioner is neither named in the FIR nor there is any incriminating material against him in course of investigation, but simply because he happens to be Manager of Jai Ambey Agency the police is bent upon to apprehend him in the present case. He submitted that from perusal of the FIR it would be evident that brother-in-law of the victim had purchased an old tractor and agricultural equipments after knowing everything and the

On the other hand, learned counsel for the State submitted that the brother-in-law of the informant was cheated as instead of new tractor an old tractor was delivered to him. Regard being had to the nature of allegation and the submissions made on behalf of the parties, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jahanabad in connection with Jahanabad P.S. Case No.319 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
