Mr.Ashok Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE VIKASH JAIN ORAL ORDER 26-04-2019 Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 324, 379, 307,448,504,506/34 IPC registered in connection with Assaon P.S. Case No. 137/2018.
3. It is submitted that the petitioners have been falsely implicated and there is considerable delay in institution of the FIR on 17.12.2018 for the alleged occurrence of 05.12.2018. As a matter of fact, the petitioners' side had instituted Assaon P.S. Case No. 131/2018 on 06.12.2018 itself and the present case has been filed only as a counter blast. The accusation of assault on informant's mother-in-law Fulpati Devi is attributed to co-accused Sonu Kumar and not on these petitioners. The accusation of taking away mobile, cash of Rs. 7,500/- and gold chain are mere embellishment. The petitioners claim clean antecedents.
