The petitioner apprehends his arrest in Narpatganj P.S. Case No. 737/2018, registered for the offences punishable under Section 414 of the Indian Penal Code.
The informant (Inspector S.S.B. Department) got secret information that some persons are crossing with the theft and smuggled cattle. On chase, the informant along with other police officials saw that a boy with two cattles was running towards Achra Village and after seeing the police party the boy fled away. Thereafter, local people gathered there and disclosed the name of that boy as Md. Mustaquim (petitioner). It is submitted on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this
Patna High Court CR. MISC. No.27077 of 2019(2) dt.17-07-2019 2/2 case. Petitioner has no concern with the seized cattle. Petitioner has got no criminal antecedent. It is also submitted by this petitioner that source of identification of the petitioner has not been disclosed by the informant.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 737/2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
