JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-07-2018 The petitioner seeks bail in anticipation of his arrest in connection with Kochadhaman P.S. Case No. 201 of 2014 dated 29.08.2014 instituted for the offences under Section 7 of the Essential Commodities Act.

Two pick-up vans carrying Urea were intercepted. The Urea was about to be sold in the black-market. The petitioner happens to be the driver of one of the vehicles which has been intercepted. Neither the petitioner is PDS dealer nor was he aware that the aforesaid article which was loaded on his pick-up van was not meant to be transported or sold in the market.

Regard being had to the aforesaid facts, the petitioner, above named, in the event of his arrest or

Patna High Court Cr.Misc. No.33782 of 2018 (2) dt.05-07-2018 2/2 surrender before the learned Court below within a period of four weeks from today is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Kishanganj in connection with Kochadhaman P.S. Case No. 201 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
