Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Petitioner is in custody since 20.11.2019. 172 litres of liquor was allegedly recovered from possession of the petitioner and co-accused.
Since, the petitioner is carrying criminal antecedent, this Court had refused prayer for bail on 14.01.2020 with liberty to renew the prayer before the learned court below if the trial is
Patna High Court CR. MISC. No.28678 of 2020(2) dt.06-11-2020 2/2 not concluded within six months of the production of the copy of the order.
The impugned order reveals that trial has not concluded, not because of the non-cooperation of the petitioner. Considering the circumstance, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Koraiansari Police Station Case No. 64 of 2019/Excise G.R. No. 646 of 2018, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
(c) The petitioner shall not leave the country without permission of the learned trial court.
