2. The petitioners apprehend arrest in connection with Complaint Case No. 780 C of 2016 registered for offences under Sections 323, 420, 120B, 406, 467, 468, 379, 427, 504 of the Indian Penal Code.
3. As per the complaint, the petitioner no. 1 is the brother of the complainant. The thrust of the complaint is that the father had executed a sale-deed in favour of the petitioner no. 2 who is none-else but the wife of the petitioner no. 1.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.28715 of 2025(5) dt.17-02-2026 2/2 petitioners are quite innocent and have not committed any offence.
5. Learned counsel for the complainant has vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the case and the relationship between the parties, this application for anticipatory bail is allowed.
7. Accordingly, let the petitioners, above-named, in the event of their arrest or surrender within four weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul/concerned court below in connection with Complaint Case No. 780 of 2016 subject to the conditions as laid down under Section 482(2) of the BNSS.
