The petitioner apprehends his arrest in connection with Fulkaha P.S. Case No. 177 of 2018 registered under Sections 379 and 411/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that petitioner is a co-driver of the vehicle. He is innocent and has falsely been implicated in the present case with ulterior motive. The vehicle in question was hired by the co-accused for transportation of cattle and the petitioner has no concern with the alleged occurrence.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below

Patna High Court CR. MISC. No.29975 of 2019(2) dt.16-05-2019 2/2 within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Araria in connection with Fulkaha P.S. Case No. 177 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
