Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Araria P.S. Case No. 129 of 2019 for the offenses under Sections 379 and 414/34 of the Indian Penal Code.

It is alleged that a motorcycle of the informant was stolen on 20.2.2019 and on the same day the said motorcycle was recovered from the house of one Masnikant Singh who disclosed the name of the petitioner involved in the commission of the crime.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.27009 of 2019(2) dt.24-04-2019 2/2 petitioner has no criminal antecedent. The petitioner is in custody since 21.2.2019.

Considering the fact that the petitioner has no criminal antecedent, his name was disclosed by the co-accused and nothing was recovered from the possession of the petitioner, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 129 of 2019.
