The petitioner apprehends his arrest in Complaint Case No.1064/2017, registered under Sections 494, 497, 384 and 506 of the Indian Penal Code.

The petitioner happens to be brother-in-law of the complainant. The complainant alleged that his wife went to her Naihar but she refused to come to the house of the complainant. Later on, the wife of the complainant solemnized marriage with Bhuwal Ram. The complainant filed a case for restitution of conjugal life. The wife of the complainant also filed case under Section 498A of the Indian Penal Code and Section 3⁄4 of Dowry

Patna High Court Cr.Misc. No.34367 of 2018 (2) dt.29-06-2018 2/2 Prohibition Act. The complainant alleged that when he went to bring his wife, Bhuwal Ram is said to have assaulted and he forcibly took his signature on a blank paper by putting country made pistol.

Learned counsel for the petitioner submits that there is no specific allegation against the petitioner. The entire allegation is false and concocted. The wife of the complainant does not want to live with her husband, hence the complainant filed this false case.

Considering the aforesaid fact, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Kaimur at Bhabua, in connection with Complaint Case No.1064 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
