JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-01-2021 Heard Mr. Sunil Kumar Singh, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with 86 C2 of 2020 instituted for the offence under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.
Though there has not been any recovery from the physical possession of the petitioner but considering the fact that he was earlier made accused in a case of similar nature, I am not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail is rejected.

No.30929 of 2020(2) dt.04-01-2021 2/2 However, if the petitioner surrenders before the Court below and seeks bail, his application shall be considered on its own merit without being prejudiced by the fact that the present petition for grant of anticipatory bail has not been entertained.
