The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 452, 354(C), 504/34 of the Indian Penal Code and Section 8/12 of the Protection of Children from Sexual Offences Act. Supplementary Affidavit has been filed today. Both the petitioners claim to be juvenile aged about 15 and 16 years. Hence, no proceeding of the petitioners before the regular criminal Court is maintainable.
Accordingly, this anticipatory bail application stands dismissed as not maintainable in connection with Sadar Police Station Case No. 294 of 2016 (Special Case No. 49 of 2016) pending in the court of learned 1st Additional Sessions Judge-cum-
Patna High Court Cr.Misc. No.42208 of 2016 (5) dt.10-02-2017 2/2 Special Judge, Purnea.
