Petitioners are apprehending arrest in connection with Chaki P.S. Case No. 16 of 2016 for an offence under sections 409 and 353 of the Indian Penal Code.

Allegation as per FIR against this petitioners is that he caused delay in furnishing folder of the Niyojit Teachers for vigilance enquiry.

Counsel for the petitioners submits that subsequently desired folder was produced by the petitioners and for such delay the petitioners cannot be fastened with any criminal libility. Considering the peculiar facts of this case and the fact

No.49215 of 2017 (2) dt.18-10-2017 2/2 that the allegation is only of delay in submission of folder of Niyojit Teachers for the vigilance enquiry, the court is inclined to grant bail to the petitioners, named above, in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IInd, Jamui, in connection with Chakai P.S. Case No. 16 of 2016 subject to the condition as laid down under section 438(2) of the Cr.P.C. (Anil Kumar Upadhyay, J) Ravi/- U T
