This application, for grant of regular bail, arises out of Ekma Police Station Case No. 177 of 2021, disclosing offences under Section 395 of the Indian Penal Code.
The allegation, as per the First Information Report is that 8-9 persons on the point of pistol looted cash of Rs.17,56,299/- and fled away.
Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case. His name has transpired during the course of investigation on the basis of confessional statement made by co-accused. It is further submitted that no looted article has been recovered from
Patna High Court CR. MISC. No.38785 of 2021(2) dt.13-12-2021 2/2 the physical possession of this petitioner. The alleged recovery of cash, mobile and motor vehicle belong to this petitioner. None of them have been put on T.I. Parade or identified by the informant. Petitioner claims clean antecedent and is in custody since 25.05.2021.
Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that petitioner is in custody since 25.05.2021 having no criminal antecedent, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Chapra, Saran, in connection with Ekma Police Station Case No. 177 of 2021.
