JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-04-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in S.Tr. No. 448 of 2018 arising out of Bhairavsthan P.S. Case No. 53 of 2014 for the offenses under Sections 395, 397, 364, 412 and 120 (B) of the Indian Penal Code.

Learned counsel for the petitioner would submit that initially the case was registered under Section 394 of IPC against unknown, but the police after investigation submitted charge sheet under Sections 395, 397, 364, 412 and 120(B) of IPC. He further submits that the petitioner is in custody since 02.03.2019, but he has not been put on TIP.

Considering the fact that case was registered against unknown and the petitioner was not put on TIP, let the
