The petitioners herein are the mother- in-law and father-in-law of the deceased respectively and pray for grant of anticipatory bail in connection with Raghunathpur P.S. Case No. 81 of 2016, registered under Sections 304B/34 of the IPC. Within few months of marriage of daughter of the informant with the son of the petitioners she was tortured on account of non fulfillment of the demand of dowry and was done to death while at sasural inasmuch as an attempt was made to burn her in the house itself. On getting such information, the informant visits the sasural to find the dead body of her daughter. It is submitted that the allegation is general and
Patna High Court Cr.Misc. No.47646 of 2016 (3) dt.16-12-2016 2/2 omnibus. The petitioners are quite old persons. The husband may be responsible for the unnatural death of his wife. Learned counsel for the State, on the other hand, points out from the case diary that the allegations have been supported by the witness as well as the post mortem. In my view, it is not a fit case for grant of anticipatory bail. Prayer is, accordingly, rejected. Let the petitioners surrender and pray for bail before the Court below. It they do so, the same shall be considered on its own merit unprejudiced by the present order.
