JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Motipur P.S. Case No. 90 of 2019, registered for the offences punishable under Sections 30(a), 38(1) and 41(1) of Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 171 litres of liquor from the latrine tank of the house of the petitioner and he is accused in one more case of similar type.

Submission of learned counsel for the petitioner is that the latrine tank is situated outside the house and he has falsely been implicated in this case.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if the petitioner

With the above observation, this application is dismissed.
