JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-01-2021 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor representing the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 392 of the Indian Penal Code.
As per FIR, four unknown motorcycle borne miscreants looted jewellery, passbook and cash of Rs.16,500/- from the informant.
Learned counsel for the petitioner submits that save and except confessional statement of co-accused Virajan Kumar no other material has come against him. Some of the stolen articles have been recovered from a vehicle which was parked near the house of the petitioner as per the seizure list. In the facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate 3, Vaishali at Hajipur in Rajapakar Police Station Case No. 53 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
