JUSTICE BIRENDRA KUMAR ORAL ORDER 28-10-2021 This matter has been taken up out of turn hearing as the petitioner stated in the mentioning slip that his father has recently died and the petitioner has to participate in the shradh ceremony.
Let the defects, if any, be removed within two weeks of the complete start of the physical Court.
Heard the parties.
The petitioner is languishing in custody for the offence punishable under Sections 414, 420, 467, 468, 471 and 120B of the Indian Penal Code and Sections 30(a), (c), (d), 36/41(i) of the Bihar Prohibition and Excise Act. Allegation is of recovery of liquor. Petitioner has got no criminal antecedent. Petitioner is in custody since 11.04.2021. Investigation of the case is already complete.

No.38457 of 2021(2) dt.28-10-2021 2/2 Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Lalganj P.S. Case No. 369 of 2020, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
If the court below would come to notice that the petitioner made wrong statement before this Court regarding death of his father that would be a ground for cancellation of bail of the petitioner by the court below itself as well as for initiating criminal proceeding against him.
