JUSTICE ANIL KUMAR SINHA ORAL ORDER 20-08-2019 Learned counsel for the petitioner is present with his client in person as well as learned counsel appearing for Opposite Party No.2 is also present with his client. Petitioner apprehends his arrest in connection with Darbhanga Mahila (Baheri) P.S. Case No.76 of 2018 for the offence punishable under Sections 498(A), 323, 504, 354 and 34 of the Indian Penal Code.

Both the petitioner and Opposite Party No.2 has agreed that they are willing to live together as husband and wife and petitioner has assured that he will be taking care of his wife and child with all dignity and affection. The petitioner, namely, Chotte Lal, who is present in Court also assures that he will go

Patna High Court CR. MISC. No.28862 of 2019(5) dt.20-08-2019 2/2 to his Sasural on 24.08.2019 to bring his wife, i.e., Opposite Party No.2, namely, Kanchan Devi from her Miaka. Opposite Party No.2 has agreed that she will go with her husband on 24.08.2019 in order to live with him in her matrimonial home. In view of the above agreement between the parties, let the petitioner visit sasural on 24.08.2019 for Bidai of Opposite Party No.2 from her Miaka.

In that view of the matter, let the petitioner, above named, is directed to surrender before the learned Court below within a period of four weeks from today and in the event of surrender by him, he shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Darbhanga, subject to the condition that petitioner as well as Opposite Party No.2 will submit their respective affidavits before the Court below that both the parties are living together amicably and peacefully. The petitioner will attach his affidavit duly sworn by the Opposite party No.2 along with his surrender-cum-bail petition before the Court below.
