2. In the present case, the petitioners are apprehending their arrest in connection with Sigori P.S. Case No. 7 of 2026, dated 07.01.2026, registered for the offences punishable under Sections 190, 191(2), 191(3), 117(2), 109, 303(2) and 351(2) of the B.N.S., 2023.

3. As per prosecution case, the petitioners who are neighbours of the informant assaulted the informant, his father

2/4 and his uncle causing a number of injuries to them.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. The only specific allegation is against petitioner no. 1 for stabbing the father of the informant, but the injury report of the father of the informant does not show any knife injury and injuries of the father of the informant appears to be quite simple and superficial and one of the injuries is lacerated wound over left ear of size 5 cm and another injury is swelling over left forearm of size 2.5 cm.

The allegation against other petitioners is general and omnibus for indiscriminate assault with lathi, but injury report of the informant shows a cut injury on middle of head of size 5 cm x 3 cm x skin, whereas injury over the uncle of the informant is again a cut injury on head of size 5 cm x skin thick and the injuries of both the persons are stated to be simple caused by hard and blunt object. Thus, the injury reports falsify the allegation of indiscriminate assault. Learned counsel further submits that there is counter version and Sigori P.S. Case No. 8 of 2026 has been instituted on the basis of written report of Chinta Devi, petitioner no. 4, as petitioners themselves received a number of injuries which remain unexplained and the informant's side is aggressor.

3/4 that the petitioners are having antecedent of one case and they are on bail.

5. Learned APP as well as learned counsel for the informant oppose the submissions made on behalf of the petitioners. Learned counsel for the informant submits that the petitioners brutally assaulted the informant and his family members and the petitioners are also having criminal antecedent. Learned counsel further submits that a Complaint Case is also pending against petitioner no. 1 which has not been mentioned, but at the same time admits that cognizance has been taken in this case and summons has been issued.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the counter version and injuries of the petitioners and in this background probability of false implication, let the petitioners, above-named, in the event of their arrest or surrender before the Court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Danapur (Patna), in connection with Sigori P.S. Case No. 7 of 2026, subject to the conditions as laid down under Section

4/4 482(2) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioners.

(ii) The petitioners will remain present on each and every date fixed by the Court below, if so required by the learned trial Court.
