The petitioners apprehend their arrest in Kadamkuan P.S. case No. 225/2015 under Section 304B, 201/34 of the Indian Penal Code.
The informant alleged that his sister was married to Santosh Kumar Gupta in the month of February, 2013 but his sister was killed by her husband and other in-laws on 26.05.2015. The learned counsel for the petitioners submits that petitioners are mother-in-law and brother-in-law of the deceased. The husband of the deceased has already been enlarged on regular bail. It has come during the course of investigation that deceased was ill and she was under treatment of a doctor, who gave death
Patna High Court Cr.Misc. No.41224 of 2016 (2) dt.06-10-2016 2/2 certificate. The deceased was cremated at Gulbi Ghat, Patna in which close relatives of the informant also participated. Considering the facts aforesaid and the fact that husband of the deceased has already been enlarged on regular bail, the petitioners are mother-in-law and brother-in-law of the deceased and no specific allegation is made against them, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st class, Patna in Kadamkuan P.S. Case No. 225 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
