JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Lalganj P.S. Case No.58 of 2020 for the offences under Sections 25(1-b)a, 26 and 35 of the Arms Act and Sections 20,22, 23, 24, 27 and 29 of the Narcotic Drugs and Psychotropic Substances Act.

Learned counsel appearing on behalf of the petitioner would submit that the petitioner is 23 years old and he has been made accused in this case for the alleged involvement in carrying Charas from Nepal. Petitioner is in custody since 20.02.2020.

Considering the fact that the petitioner, who is 23

No.29320 of 2020(2) dt.10-11-2020 2/2 years old, is in custody since 20.02.2020, the Court is inclined to grant bail to him subject to the condition that the petitioner has to deposit Rs.1,00,000/- in cash. On depositing the amount of Rs.1,00,000/-, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees one lakh) with two sureties of the like amount each to the satisfaction of 1st Additional District & Sessions Judge-cumSpecial Judge N.D.P.S. Act, Hajipur, Vaishali in connection with Lalganj P.S. Case No.58 of 2020.
