JUSTICE PARTHA SARTHY ORAL ORDER 14-10-2020 Heard learned counsel for the petitioners and learned APP for the State, through video conferencing. The petitioners have filed the instant application for grant of anticipatory bail apprehending their arrest in connection with Kashichak P.S. Case No. 32 of 2020 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016. As per allegation in the FIR, on a raid being conducted, a total of 90 litres of illicit liquor was recovered from the agricultural land, east of the village. It is submitted by learned counsel for the petitioners that neither the land from which the recovery was made nor the liquor belongs to the petitioners. They have no criminal antecedent.The application for bail is opposed by learned APP

Patna High Court CR. MISC. No.24661 of 2020(2) dt.14-10-2020 2/2 for the State.

Having heard learned counsel for the parties and taking into consideration the aforesaid facts including the petitioners not having any criminal antecedent, the Court is inclined to enlarge the petitioners on anticipatory bail. The petitioners are directed to surrender in the Court below within a period of eight weeks from today and in the event of their arrest or surrender in connection with Kashichak P.S. Case No. 32 of 2020, they shall be enlarged on bail on each of them furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Nawada subject to the conditions as laid down under section 438(2) of the Cr.P.C.
