2. The petitioner seeks bail in a case registered for offence under Sections 21(b), 22(b) of the N.D.P.S. Act.

3. As per prosecution case, 9.500 gram of Heroin was recovered from the shop of co-accused Pappu Kumar Yadav, who disclosed the name of this petitioner.

4. Learned counsel for the petitioner submits that no incriminating article has been recovered from possession of this petitioner and has been made accused only on the disclosure made by co-accused Pappu Kumar Yadav, from whose shop, aforesaid recovery has been effected. Petitioner is in custody since 17.12.2024. Chargesheet has been submitted.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

6. Considering the period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, NDPS Act, Aurangabad / concerned Court in connection with Aurangabad (Town) P.S.
