In this application for anticipatory bail the petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 109 of 2017/ G.R. No. 1063 of 2017 for the offences punishable under sections 323, 324, 307 and 504/34 of the I.P.C. Allegedly, the petitioner assaulted the informant with khanti and other co-accused assaulted the informant with iron rod and when the nephew of the informant came to save him he was also assaulted.
Submission is of false implication and that there is no specific allegation against the petitioner, the allegations are omnibus and general in nature, during investigation also the
Patna High Court Cr.Misc. No.56292 of 2017 (3) dt.16-01-2018 2/2 witnesses have alleged general and omnibus allegation, from the injury reports of both the injured it would reveal that lacerated wound, abrasion etc. have been found by the doctor and no injury has been found on the vital part of the body and similarly situated co-accused Ranjan Mahto and Saurabh Kumar have been allowed pre-arrest bail vice Cr. Misc. No. 34603 of 2017 by another coordinate Bench of this Court. The learned A.P.P. fairly submits that two other coaccused have been allowed pre-arrest bail. In the facts and circumstances stated above, the petitioner, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M, Munger in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
