The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code and Section 8 of the Protection of Children From Sexual Offences Act.

It is alleged that minor girl of the informant has been abducted by all the F.I.R named accused persons including the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and he has falsely been implicated in this case, just because there is love affair in between the petitioner and the daughter of the informant. From the persual of the impugned order, it appears that the victim solemnized marriage with the petitioner. Marriage certificate

Patna High Court CR. MISC. No.29304 of 2022(2) dt.01-11-2022 2/2 issued by the Marriage Officer, Motihari, is annexed with the petition as Annexure 2. It is further submitted that the victim in her statement recorded under section 164 Cr.P.C in which she has disclosed that she of her own sweet-will left her house and went along with the petitioner and she solemnized marriage with him. She has not alleged any complicity of the petitioner in her elopement.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge-cum-Special Judge, POCSO Act, East Champaran, Motihari, Raxaul in connection with Raxaul P.S. (Haraiya O.P.) Case No. 432 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) nirajkrs/- U T
