17-03-2017 Heard Sri Binay Kumar Mishra, learned counsel for the petitioner and learned A.C. to Govt. Pleader - 10. The present petition has been filed with a prayer to restore C.W.J.C. No. 23472 of 2012, which stood dismissed due to non-compliance of peremptory order dated 03-01-2013. By the said order, it was directed to remove defect by 07-01-2013. After hearing learned counsel for the parties and considering the facts & circumstances, as indicated in the petition, same is allowed.

Let C.W.J.C. No. 23472 of 2012 be restored to its original file.

It is clarified that if order dated 03-01-2013 passed in C.W.J.C. No. 23472 of 2012 is not complied with within a period of three weeks from today, the writ petition i.e. C.W.J.C. No.

Patna High Court MJC No.5653 of 2013 (3) dt.17-03-2017 2/2 23472 of 2012 shall stand dismissed without further reference to a Bench.
