29-06-2018 Heard Sri Poddar Suresh Gandhi, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Beldaur P.S. Case No. 32 of 2018, G.R. No. 470 of 2018 registered for offence under Section 30 of Bihar Prohibition and Excise Act, 2016, has prayed for grant of anticipatory bail. Learned counsel for the petitioner, at the very outset, submits that petitioner is having clean antecedent and this fact has been stated in paragraph - 3 of the petition. He further submits that in this case, nothing was recovered either from conscious possession of the petitioner or from his premises, rather in the case, from behind back of the house of the petitioner, about 2 litres of Indian make foreign liquor was shown to be recovered and from petitioner's house, one empty
Patna High Court Cr.Misc. No.37189 of 2018(2) dt.29-06-2018 2/2 bottle was found.
In view of nature of accusation as well as clean antecedent, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner namely Lalo Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Khagaria in connection with Beldaur P.S. Case No. 32 of 2018, G.R. No. 470 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. (Rakesh Kumar, J.) anay U T
