The petitioner seeks bail in Pakridayal P.S. Case No.312 of 2019, registered under Section 394 of the Indian Penal Code.

The informant lodged the case against unknown for robbery of Rs.2,50,000/- from the dickey of his motorcycle. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Name of the petitioner surfaced in the case in the confessional statement of co-accused. Save and except the confessional statement of co-accused, the police did not collect any further tangible material to show the

Patna High Court CR. MISC. No.25111 of 2020(2) dt.22-09-2020 2/2 involvement of the petitioner in the alleged robbery. The petitioner is in jail since 06.01.2020 and the Investigating Officer did not put the petitioner on TIP.

Taking into consideration the facts aforesaid and the fact that the petitioner is in jail since 06.01.2020, the petitioner, namely, Rajendra Sahani is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 5th, Motihari, East Champaran in connection with Pakridayal P.S. Case No.312 of 2019.
