The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 302, 306 and 34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and petitioner no.2 is a woman and the informant alleges that on 14.02.2021, petitioner no.1 and Chandan came and threatened to kill his brother Sandeep, further on 14.02.2021 his brother went to shop at 7.00 PM but did not return, later on 15.02.2021 his dead body was found.

No.30463 of 2022(3) dt.22-12-2022 2/3 Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that informant is not an eye-witness to the occurrence and the entire allegation hinges around suspicion, it is next submitted that during the course of investigation it has come that the deceased was in love with the niece of the accused persons, including the petitioners, and he committed suicide, it is next submitted that charge-sheet has been submitted under Section 306 of the Indian Penal Code against the accused persons, who were apprehended The learned counsel for the petitioners next submits that petitioners will not evade the law rather will co-operate in the investigation and will present as and when required by the Investigating Officer of the case, so that truth comes out. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like
