The petitioner is apprehending his arrest in Complaint Case No. 2930 of 2011, Tr. No. 4742 of 2013 registered under Sections 498A, 323, 406, 494/104 of the Indian Penal Code. Allegation against the petitioner is of committing torture upon the victim due to non-fulfilment of demand of dowry.

The petitioner was granted provisional bail vide order dated 19.03.2014 passed in Cr. Misc. No. 3344 of 2014 with a direction that the petitioner shall continue to pay the maintenance amount to the complainant and file a certificate in

No.38345 of 2018(3) dt.24-07-2018 2/2 this regard before the Court below and in case he defaults in doing so on two consecutive months without any reasonable cause, his bail bonds shall stand automatically cancelled. Subsequently, since the direction of the Court was not complied with, the bail of the petitioner was cancelled by order dated 24.09.2014. This is second anticipatory bail application of the petitioner.

Considering the aforesaid facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Prayer is rejected. If the petitioner surrenders in the Court below and pray for regular bail, the same shall be disposed of preferably on the same day on its own merit without being prejudiced by this order.
