JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 08-08-2018 While allowing the petitioner's privilege of anticipatory bail by order, dated 10.08.2017, passed in Criminal Misc. No. 34838 of 2017 in connection with Gaya Civil Line P.S. Case No. 117 of 2017, a condition has been put that he shall present himself before the police/court as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.

The petitioner seeks modification of that part of the order whereby the condition for his appearance has been put. It is submitted by learned counsel appearing on behalf of the

Patna High Court Cr.Misc. No.35226 of 2018(2) dt.08-08-2018 2/2 petitioner that the petitioner is under threat of harm by the informant and, therefore, sometimes becomes difficult for him to appear before the court below.

I do not find the explanation to be cogent and a valid ground for modification of the order.

It is, however, indicated that if any application is filed on behalf of the petitioner, seeking exemption from his personal appearance on a particular date, the present order should not come in the way of the court for passing appropriate order. This application stands disposed of with the observations as above.
