This Court would expect that the petitioner's Counsel would honour his undertaking in the instant proceedings regarding supply of requisite court fee etc. within two weeks from the date he is called upon to do so by the office. Petitioner apprehends arrest in Buxar Mufassil PS Case No. 349 of 2019 registered under Section 394 of the IPC. The allegation is that 13000 and odd rupees has been looted from the informant.

The petitioner's name as per the submission of the learned Counsel for the petitioner, is stated by co-accused Maksood Mansuri. However there is no recovery either from the said co-accused or from the instant petitioner to connect him with the alleged occurrence. After some argument, learned Counsel for the petitioner submits that he would be raising this issue before the court concerned while he makes the prayer for grant of regular bail. In view of said submission and with liberty to do so this application is permitted to be withdrawn.
