JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 04-07-2023 Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State. The petitioner seeks bail in connection with Tajpur P.S. Case No.584 of 2022 registered for the offence under Sections 341, 323, 325, 354-B, 498-A, and 304-B/34 of the Indian Penal Code.
The accused/petitioner is named in the F.I.R. and is in custody since 04.12.2022.
The allegation against the petitioner is to cause death
Patna High Court CR. MISC. No.29564 of 2023(3) dt.04-07-2023 2/3 of the daughter of informant alongwith other co-accused/family members due to non-fulfillment of demand of dowry as raised for cash of Rs. 3,00,000/- and one motorcycle. Learned counsel appearing on behalf of the petitioner submitted that petitioner is father-in-law and living separately having no connection with the daily and domestic affairs with the deceased and her husband and his implication in the present case is only for the reason being father-in-law of the deceased. It is also submitted that husband of deceased is in judicial custody against whom thrust of allegation is available. While concluding the argument, it is submitted that petitioner is a man of clean antecedent and moreover, investigation of this case has been completed, for which, charge-sheet has already submitted, as such, there is no chance of tampering with the evidence. Learned APP appearing on behalf of the State, opposes the prayer for bail.
In view of the facts and circumstances as mentioned above as petitioner is father-in-law, living separately having no connection with daily and domestic affairs coupled with the fact that charge-sheet has already submitted, where petitioner is in custody since 04.12.2022, accordingly petitioner above named petitioner is directed to be released on bail in connection with

Case No.584 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur/concerned court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C.
