====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-05-2024 Pre-arrest bail application with regard to petitioner No. 1, namely, Raja Sahni has already been dismissed as withdrawn vide order dated 30.04.2024.

2. Heard learned counsel for the parties.

3. Petitioner No. 2 apprehends arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

4. As per prosecution case, 288 litres illicit liquor has been recovered from the house of co-accused Manager Sahni.

5. Learned counsel for the petitioner submits that the no incriminating material has been recovered from conscious possession of the petitioner and he has been made accused in

Patna High Court CR. MISC. No.32837 of 2024(3) dt.06-05-2024 2/2 this case only on suspicion. Petitioner has got no criminal antecedent of similar nature.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner No. 2 in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Judge II (Excise Act), Darbhanga in connection with Bahera P. S. Case No. 63 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
