JUSTICE BIRENDRA KUMAR ORAL ORDER 07-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 354, 323 and 379 of the Indian Penal Code.

Allegation based on complaint. Case is that the petitioner entered into the house of the complainant and pulled her Saree with some illicit purpose. Further allegation is of commission of assault.

Contention of the petitioner is that land dispute is going on between the parties and just to pressurize, the false allegation is there.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the

Patna High Court Cr.Misc. No.52556 of 2016 (2) dt.07-12-2016 Court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Gopalganj/Successor Court in connection with Complaint Case No. 2537 of 2014, Trial No. 1679 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
