The petitioners apprehend their arrest in Barun P.S. Case No.85 of 2018 registered under Sections 379, 411, 420 and 34 of the Indian Penal Code and under Section 4 and 40 of the Bihar Minor Mineral Concession Rule and Section 15 of the Environment Protection Act.

The informant alleged that many people were illegally extracting sand and loading the sand on their tractors. The learned counsel for the petitioners submits that petitioners are alleged to be the owner of different tractors mentioned therein. The tractors of the petitioners were hired for

Patna High Court Cr.Misc. No.33967 of 2018 (2) dt.28-06-2018 transportation of sand. It is further submitted that similarly situated other accused persons have already been granted anticipatory bail.

Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No.85 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
