The petitioner apprehends his arrest in Special Case No.68(A) of 2018 arising out of Nadi P.S. Case No.127 of 2018 registered under Sections 8, 20, 22, 25, 29 of N.D.P.S. Act. The police, on secret information, intercepted an auto rickshaw bearing registration No.BR-01PE-5335 and apprehended two persons who disclosed their names as Sonu Kumar and Satish Das. On search, 9 pockets each containing 2 kgs. ganja were recovered from the cavity inside the seats of the auto rickshaw. The apprehended driver and co-driver of the auto rickshaw disclosed the name of the petitioner that petitioner was also involved in transportation of ganja with them. The learned counsel for the petitioner submits that petitioner has no manner of concern with the recovered ganja from the possession of Sonu Kumar and Satish Das. Petitioner has got no criminal antecedent and save and except the so called confessional statement of the driver and co-driver of auto

Patna High Court CR. MISC. No.29900 of 2019(2) dt.08-05-2019 2/2 rickshaw, there is no other tangible material to show the involvement of the petitioner. Sonu Kumar and Satish Das, from whose possession 18 kgs. ganja was recovered, have already been granted regular bail by order passed in Cr. Misc. No.72205 of 2018 and Cr. Misc. No.1209 of 2019.

Taking into consideration the fact that save and except the confession of driver and co-driver of the auto rickshaw who disclosed the name of the petitioner as the person involved in transportation of ganja with them there is no material to show the involvement of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Patna in connection with Special Case No.68(A) of 2018 arising out of Nadi P.S. Case No.127 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
