2. Petitioner apprehends her arrest in a case registered for the offence punishable under sections 80 and 3(5) of BNS. 3 . It is a case of dowry death . As per prosecution case , informant namely Suresh Das alleged that his daughter Chandani Kumari was married to Ram Babu Das Ram 05.05.2024 and soon after the marriage , she was subjected to cruelty and torture by all the accused persons named in the F.I.R., due to non-fulfillment of demand of dowry . It is further alleged that all the F.I.R., named accused persons killed daughter of informant by administering poison to her.
4. It is submitted on behalf of the petitioner that petitioner is innocent and has committed no offence as alleged.
Patna High Court CR. MISC. No.29687 of 2025(2) dt.14-05-2025 2/2 Petitioner is mother-in -law of the deceased. She is simply victim of over implication . She is separate in mess and property and has got no concern with the affairs of couple . It is further orally submitted that husband of deceased has already surrendered and is in custody since 13.05.2025 . Petitioner claims clean antecedent.
5 . Learned counsel for the State opposed the bail petition .
6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class Benipatti in connection with Harlakhi P.S. Case No. 307 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
