The petitioner has filed this petition for modification of the order dated 16.09.2015 passed in Cr. Misc. No. 18100 of 2014. The petitioner filed Cr. Misc. No. 18100 of 2014 for grant of anticipatory bail. The petitioner was granted provisional anticipatory bail vide order dated 01.05.2014 and he was directed to pay a sum of Rs. 750/- to his wife for her maintenance. Vide order dated 16.09.2015, provisional anticipatory bail granted to the petitioner was confirmed and he was directed to pay Rs. 1200/- per month to his wife.

It is submitted that wife has already been divorced in accordance with law vide judgement passed in Matrimonial case No. 37 of 2014. The wife of petitioner also filed maintenance case but the same was dismissed.

It appears that the criminal case in which the petitioner

Patna High Court Cr.Misc. No.48859 of 2016 (2) dt.16-12-2016 2/2 was granted anticipatory bail is still going on and the wife has not been granted any maintenance till date. Therefore, I do not find any substance in the petition for modifying the order dated 16.09.2015 by which maintenance was granted to the wife. The modification petition is, accordingly, dismissed.
