The petitioner prays for anticipatory bail in connection Raniganj PS case no. 111 of 2016 registered for the offence punishable under section 448, 342, 323, 325, 379/34 of Indian Penal Code.
It is submitted on behalf of petitioner that petitioner is named in FIR but except Section 379, all other sections are bailable in nature and for section 379 IPC, no specific allegation has been attributed against the petitioner. However, prior to filing of this case, daughter of petitioner no. 4 has lodged a
Patna High Court Cr.Misc. No.54465 of 2016 (2) dt.13-01-2017 2/2 case against family members of informant for offences under Section 354 and 379 IPC and the present case is a counter blast to that case.
Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail.
Having heard both sides. In above view of the matter, the anticipatory bail application of petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Araria in connection with Raniganj P.S. case no. 111 of 2016 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
