====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 28-07-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in connection with Mau P.S. Case No. 102 of 2024 dated 06.12.2024 registered for the offences punishable under Section 80 read with Section 3(5) of the B.N.S., 2023.
3. As per the prosecution case, the petitioner and the other co-accused persons are alleged to have killed the informant's daughter due to non-fulfilment of motorcycle as dowry.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the petitioner is the father-in-law of
Patna High Court CR. MISC. No.29425 of 2025(3) dt.28-07-2025 2/3 the deceased. The petitioner neither demanded any dowry nor tortured the deceased. There is general and omnibus allegation against the petitioner. The petitioner is separate in mess and property from the husband of the deceased. He has no concern with the alleged offence. It is further submitted that the husband of the deceased is already in jail custody. It is further submitted that the deceased and her husband are residing in the house of the petitioner and some hot talk took place between them and when the husband of the deceased went outside the house, the deceased committed suicide by hanging herself on the lintel with the help of her sari.
The husband of the deceased informed his father-in-law and his entire family members about the said incident and thereafter they came and dead body of the deceased was cremated in their presence but due to dirty village politics, the informant has lodged the present false case against the petitioner and his family members. It is further submitted that during the course of investigation, no any evidence has come against the petitioner by the local police. There is no eye witness to the alleged offence. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 17.12.2024.
5. Learned A.P.P. for the State has vehemently
Patna High Court CR. MISC. No.29425 of 2025(3) dt.28-07-2025 3/3 opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Gaya in connection with Mau P.S. Case No. 102 of 2024.
7. The application stands allowed.
