The petitioner apprehends his arrest in Sitamarhi P.S. case No. 928/2017 for the offences punishable under Section 414/34 of the Indian Penal Code and under Section 25(1.b)A, 26 and 35 of Arms Act.
The informant apprehended two persons who disclosed their names as Mohan Kumar and Manish Kumar and from their possession besides stolen Motorcycle, arms and ammunitions were recovered. Mohan Kumar is said to have disclosed that pistol recovered from him was given by Shibu Singh, the petitioner.
Learned counsel for the petitioner submits that nothing was recovered from the possession of the petitioner. The
Patna High Court Cr.Misc. No.34265 of 2018 (2) dt.29-06-2018 2/2 name of the petitioner was figured in the case in the statement of apprehended accused. There is no material to show that the petitioner gave pistol to Mohan Kumar.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi P.S. case No. 928/2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
