The petitioners apprehend their arrest in Roh P.S. Case No. 39/2004, registered for the offences punishable under Sections 363, 365 of the Indian Penal Code.
The petitioners are not named in the FIR. Name of the petitioners surfaced during course of investigation and charge sheet is submitted against the petitioners showing the petitioners absconder.
It is submitted that some of the accused persons have already been acquitted, but since the petitioners are absconder, I am not inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, the same is rejected.
If the petitioners, so advised, may surrender before the court below within four weeks from the date of receipt/production
Patna High Court Cr.Misc. No.46775 of 2016 (2) dt.07-12-2016 2/2 of a copy of this order and pray for regular bail and their prayer shall be considered on its own merit without being prejudiced by this order.
